Jun. 23--A decision by the Indiana Supreme Court on Friday will allow Fort Wayne to take over privately owned Aqua Indiana's north end water and sewer utility system by eminent domain.
"It doesn't mean anything at this point," said William Etzler, vice president of Aqua Indiana, of the decision. "I'm disappointed, I guess is the right word."
The utility system -- one of two owned by Aqua Indiana in and around the Fort Wayne area -- provides for about 8,800 residents in the north part of the city, many of whom were recently annexed. The city has sought the system since 2002, when it began condemnation action by eminent domain against the company.
