DuPont Co., which insists its popular fungicide Benlate DF did not cause millions of dollars in crop damage since the early 1990s, has been hit with a string of unfavorable court actions in recent months.
The Wilmington, Delaware, firm has been ordered to pay sizable back-to-back jury awards to farmers who used Benlate DF in Hawaii and South Carolina. It has also received a $1.5 million court-ordered sanction for discovery abuses in the Hawaii case. (Kawamata Farms Inc. v. E.I. du Pont de Nemours & Co., No. 91-437 (Haw., Hawaii County Cir. Ct.
