Oct. 2--EDINBURG -- An appellate court Monday denied state District Judge Migdalia Lopez's request that it halt an order to void her appointment of a special prosecutor.
Lopez appointed Gus Garza, a former Willacy County district attorney, in January to investigate present DA Juan Angel Guerra.
The 2-1 decision of the three-judge panel of the Texas 13th Court of Appeals denied Lopez's request to halt a Sept. 21 order that she void Garza's appointment.
Lopez wanted the court halt its order until she could draft a request for reconsideration of the ruling, said Paxton Warner who represents Lopez.
