Those of us who remember the Vietnam War recall "the domino theory." It went as follows: "If Vietnam falls, Southeast Asia falls. If Southeast Asia falls, there goes the whole enchilada!"
Whether or not you believe in the domino theory as it affects foreign policy or national security, the theory applies in our practice of taking discovery depositions. If one deposition goes wrong, that usually leads to a chain of events or mistakes that may influence all future discovery and may, indeed, adversely affect the outcome of the trial.
