Former murder accused Fred van der Vyver is suing the State for R17 million, saying that police made "false and misleading statements" which resulted in his prosecution.

Van der Vyver is suing Safety and Security Minister Charles Nqakula for malicious prosecution and breach of his constitutional rights "which police should have protected".

His advocate, Dup De Bruyn, confirmed yesterday that the statutory notice had been served to the Cape High Court on Friday.

He said the minister had 30 days to respond before a summons would be served.
