Federal auditors said that the CMS overstepped its authority when it issued tighter enrollment requirements for the State Children's Health Insurance Program last August, and that the agency should have first released it as a proposed rule rather than a straight directive to states. In a letter sent to Sen. Jay Rockefeller (D-W.Va.) and Sen.
