Zitha Mabuza, Phillip Simongo and Oupa Sithole escaped a life sentence for gang-raping a child - because they were between 18 and 20 at the time of the crime and grew up poor.
The success of their appeal to the supreme court of appeal (SCA) in Bloemfontein, which resulted in their life sentences being reduced to 16 years in jail, is not the exception. It is the rule.
Now, because of an appeal brought by a man sentenced to life for raping an 11-year-old mentally disabled and epileptic girl, the Mabuza case ruling and seven other "aggravated rape" sentences given by the SCA are under fire.
