READERS OF THIS JOURNAL are probably aware that in a judgement issued in June 2007, Health Services and Support--Facilities Subsector Bargaining Association v. British Columbia, (1) the Supreme Court of Canada (scc) held that the right to bargain collectively is constitutionally protected under the Charter of Rights and Freedoms' guarantee of freedom of association.
