Wearside MP Chris Mullin was one of a band of rebel Labour MPs that voted against the 42-day detention without trial for terror suspects.
Opponents have vowed to fight on to see the plans scrapped. Human rights groups say they will urge the House of Lords to oppose the change.
The plan to extend the limit for holding suspects without charge got through with just a nine-vote majority, but 36 Labour rebels joined forces with Tories and Lib Dems.
