Jul 15, 2008 (The Australian Financial Review - ABIX via COMTEX) -- The US District Court has ruled that eBay does not have a legal responsibility to prevent its users from selling fake goods on its website. The verdict, handed down in relation to a four-year-old trademark battle initiated by jewellery maker, Tiffany's, reaffirms that internet companies are not required to filter their sites for trademarked material. Electronic commerce groups such as eBay can merely rely on intellectual property holders to monitor their sites, provided the e-commerce groups remove counterfeit materials from sale once notified of their presence.
