A Raleigh, N.C., dealership that failed to fulfill its contract to supply school bus chassis must pay more than $150,000 to school districts forced to buy alternative chassis at higher prices, the North Carolina Court of Appeals has ruled.
The dealership argued it is not liable because General Motors was unable to produce the chassis and because the EPA changed emission standards for the diesel engines specified in the contract.
The decision leaves unresolved the dealership's demand for reimbursement from GM. No trial date has been announced on the issue of GM's potential liability, according to a lawyer for the schools, Walter Brinkley of Lexington.
