The Government introduced a bill on 25 June 2008 which, if passed, will amend the Family Law Act to allow disputes in relation to property and financial matters between couples to be resolved or determined by the Family Court irrespective of whether the couple are married or living in a defacto relationship.
At present any financial or property disputes between defacto couples in Queensland, have to be dealt with under the Property Law Act in Queensland.
Historically property settlement awards to defacto spouses have been less generous than those granted to married couples. Some clients may have chosen not to marry for this reason.
