With respect to Eisai's patent infringement lawsuit against Teva Pharmaceuticals and Dr. Reddy's Laboratories concerning Aciphex(R) (generic name: rabeprazole sodium tablets, Product Name in Japan: Pariet(R)), Eisai Co., Ltd. and its U.S. subsidiary Eisai Inc. (collectively "Eisai") announce that the United States Court of Appeals for the Federal Circuit has affirmed both the United States District Court for the Southern District of New York's summary judgment ruling on the validity of Eisai's composition of matter patent and its ruling on the enforceability of the composition of matter patent (see also Eisai Inc.).
