Julius Aghahowa will become a Latics player before the close of the transfer window if the club can persuade a Home Office tribunal to grant him a work permit.
The Nigeria striker has agreed a [pounds sterling]2m move from Ukraine club Shaktar Donetsk.
But the deal has been held up as he hasn't played the required amount of international games recently to automatically gain a permit.
An appeal was being heard in Sheffield this morning, with football co-ordinator Bill Green and chief executive Brenda Spencer presenting the club's case.
