A federal district court order striking down flow control won't hurt issuers of New Jersey's more than $1.6 billion of outstanding solid-waste bonds, said a lawyer representing four such issuers.
To comply with Judge Joseph Irenas' decision last week that the state's system of dictating where garbage is dumped is unconstitutional, local governments may not even have to change the statutes that regulate garbage in the state, said J.S. Lee Cohen. Cohen is a lawyer with DeCotiis, Fitzpatrick & Gluck, which represents the Hudson and Mercer county improvement authorities and the Essex and Passaic county utilities authorities, defendants in the case.
