On July 23, 2008, the United States Patent & Trademark Office (USPTO) published a notice in the Federal Register, stating that it may be illegal to outsource invention information to a foreign country for the purposes of preparing a patent application to be filed in the United States. In the notice, the USPTO reminded applicants and registered patent practitioners that exporting subject matter abroad in compliance with a valid foreign filing license is limited only to preparing, filing and prosecuting a foreign patent application and not to preparing, filing and prosecuting a U.S. patent application.
