John Hlophe, the judge president of the Western Cape, must still go before the Judicial Service Commission (JSC) to answer to the complaint made about him by the judges of the constitutional court.
This was the finding on Friday by a special five-judge bench of the Johannesburg high court.
But because the judgment also found that Hlophe's rights had been violated by the constitutional court, it seems that the Hlophe matter is nowhere nearer an end than it was a month ago - and that, if the judges of the constitutional court want to proceed before the JSC, the body that controls the behaviour of judges, ...
