On the heels of the California Supreme Court's grant of review of Brinker Rest. Corp. v. Superior Court, the Second Appellate District of the California Court of Appeal has published a new opinion addressing many of the same meal and rest period issues that were considered in Brinker.
In the similarly-named case of Brinkley v. Public Storage, Inc., B200513 (October 28, 2008), the California Court of Appeal has reaffirmed that an employer must provide an opportunity for employees to take meal and rest breaks, but need not ensure that such breaks are actually taken by the employees.
