Sandiganbayan Presiding Justice and First Division Chairman Diosdado Peralta said while the court believes the contention of the prosecution that the subject perjury case was not resolved by the Special Division, the High Court took it differently.
"The position of the prosecution is correct but as to whether or not the prosecution can present evidence not marked in the trial, we cannot go ahead. The Supreme Court resolved this issue as moot and academic because Erap was already acquitted of perjury," Justice Peralta said in open court.
