General Instrument Corp.'s NextLevel Communications subsidiary is cleared for business as usual, but it is on the hook to pay $138 million in damages to DSC Communications.
On Feb. 28, the U.S. Court of Appeals for the Fifth Circuit confirmed that no injunction will be issued against NextLevel, despite urging by DSC. The ruling ended a two-year legal battle in the federal district courts of Texas, initiated when DSC sought fiduciary damages and to prohibit NextLevel from marketing its switched-digital video products for the telco market.
