CASE ON POINT: Central Health, Inc, v. Mullins, (1/16/2009) S.E.2d--VA (2009)
ISSUE: Can one suing a hospital, nurse, physician (or other health care provider) for malpractice resulting in death, sue for both 'wrongful death' and 'survival'? That was the issue with which the Virginia courts were confronted in this unusual case.
CASE FACTS: On November 3, 2004, Leonard Mullins, age 84, was admitted to Lynchburg General Hospital, a medical facility operated by Central Health, Inc., to be treatment for a broken hip he sustained in a fall.
