NEWPORT NEWS, Va.--Aug. 20--A Dillard's rival -- Hecht's owner May Department Stores -- is behind Dillard's inability to move into Patrick Henry Mall, according to a lawsuit filed in U.S. District Court in Newport News.
Dillard's has filed a motion for a preliminary injunction. It's accusing May and the mall's owner, Crown American Financing Partnership, of "expropriating a multimillion-dollar investment" -- the $2.75 million that Dillard's paid to Proffitt's -- to buy out Proffitt's lease and fixtures in the Patrick Henry Mall.
In other words, Crown has physically blocked Dillard's from moving into Patrick Henry, despite the payment.
