Web site operators and Internet service providers that promise but fail to remove offensive material provided by third parties could find themselves liable for breach of contract, a federal appeals court ruled.
Observers say Web site operators should review their complaint procedures in light of the decision by the 9th U.S. Circuit Court of Appeals in San Francisco in Cecilia L. Barnes vs. Yahoo! Inc.
