Sens. Arlen Specter (D-Pa.), Mark Pryor (D-Ala.) and Tom Harkin (D-Iowa) now are working together on a compromise card check bill after the Employee Free Choice Act (EFCA) failed to gain the 60 votes necessary to move the bill to a vote in the Senate earlier this year. In its current form, EFCA would permit the National Labor Relations Board (NLRB) to certify a union as the employees' exclusive bargaining representative based on a majority of signed authorization cards, potentially eliminating the secret ballot process. This card check provision has given a number of lawmakers pause.
