WASHINGTON - The Supreme Court could clarify by early this summer the extent of an employer's liability for sexual harassment by lower-level supervisors when the victim did not pursue her complaint up the chain of command.
The U.S. Department of Justice already has weighed in, with Assistant Solicitor General Irving Gornstein arguing before the high court last week in Beth Ann Faragher vs. the City of Boca Raton, Fla. that the employer in this case could be held liable for at least three reasons. But where the justices will come down was far from clear by the questions they asked during oral arguments.
