MONTANA GOV. BRIAN SCHWEITZER SIGNED THE MONTANA FIREARMS FREEDOM ACT last April, and Gary Marbut and the Montana Shooting Sports Association celebrated. Marbut, as MSSA president, had written the original act in 2004, and MSSA had worked to pass it ever since. With Schwietzer's signature, the act goes into effect October 1, 2009.
As long as firearms and ammunition made in Montana are sold within and stay within Montana, the act says they are exempt from federal control because no interstate commerce is involved. In theory, that means no federal background checks, no federal paperwork, no federal excise tax.
