Madrid received, on 29 October, a letter of formal notice requesting information on its compliance with an EU Court of Justice ruling (Case C-207/07). The ECJ had ruled, on 17 July 2008, against Spain and with the Commission. The court noted that certain provisions of Spanish law, extending powers of the regulator Comision Nacional de Energia (CNE), actually instituted a system of prior administrative approval for investments in the energy field.
The ECJ upheld the Commission's arguments that Spain's new restrictive powers given to the CNE were disproportionate (in terms of safeguarding energy supply). They also constituted a restriction on the free movement of ...
