WASHINGTON - When is a packaging material considered a food additive and subject to prior approval by the Food & Drug Administration (FDA)?
Only if, based on the manufacturer's tests, it is reasonably expected to become a component of food, according to attorneys who specialize in food & drug law. That's the definition the plastics industry has been operating under for decades. However, it apparently is not the position put forth by FDA in its recently published final rule on colorants for polymers.
