The passage of the Health Insurance Portability and Accountability Act of 1996 (Act) enables the federal government to begin to address the wrongful disclosure of individually identifiable health information through the imposition of civil and criminal penalties.(1) The Act also requires the Secretary of the US Department of Health and Human Services (HHS) to establish federal regulations to serve as uniform, national standards that would secure the privacy and reliability of all such information that is maintained, transmitted, or stored electronically by health care providers, health plans, and health care clearinghouses.
