A commission appointed by U.S. Supreme Court Chief Justice William Rehnquist to study the structure of the federal appellate system has recommended that the states within the jurisdiction of the Ninth Circuit Court of Appeals should not be divided between two circuits.
The Commission on Structural Alternatives for the Federal Courts of Appeals was established by Congress in 1997 as a compromise measure. The Senate had passed legislation that would have created a Twelfth Circuit out of parts of the Ninth--the largest of the 13 circuits--but the House did not agree.
