Article: Tokyo Electron Announces: Virginia Trial Court Issues Split Decision in Tegal v. TEA Lawsuit.

AUSTIN, Texas--(BUSINESS WIRE)--Sept. 2, 1999--

In March 1998 Tegal asserted infringement of four U.S. Patents against Tokyo Electron etchers.

Two of the patents were dismissed from the suit prior to trial. On Aug. 31, 1999, a Virginia Trial Court further ruled that none of Tokyo Electron's etchers infringed Tegal U.S. Patent No. 4,585,920. The Court did find, however, that a very few Tokyo Electron etchers sold in the United States after October 1997 infringed Tegal U.S. Patent No. 4,646,223.

The Court did not award any monetary damages to Tegal but did enjoin further sales by Tokyo Electron America of the model 65DI (6inch IEM oxide) etcher ...
