BACKGROUND

The Miranda decision comes from the case of Ernesto A. Miranda, a Phoenix warehouse worker who was charged with kidnapping and rape. Miranda confessed to the charges, and his confession was used as evidence against him. Miranda, however, had not been formed of his right to remain silent and had been denied the right to consult a lawyer. The court dismissed Miranda's confession and reversed conviction.
