Felix Frankfurter once lamented that "until we have penetrating studies of the influence of [the justices] we shall not have an adequate history of the Supreme Court, and, therefore, of the United States."(1) He had reason for concern. Early judicial biographies generally were nostalgic recollections written by a family member or close personal associate shortly after a Justice's death and usually contained more tribute than analysis.(2) As late as the New Deal there were few trenchant studies of Supreme Court justices.(3) ...
