The Minnesota Appeals Court on Tuesday threw out the criminal case against a 12-year-old boy who brought a BB gun to school, saying he should have been given the Miranda warning when the principal and police questioned him.
The 7th-grader at North Middle School in Grand Rapids, Minn., was told he had no choice but to answer questions about the gun found in his backpack in September 1998, a three-judge Appeals Court panel concluded.
