The Family and Medical Leave Act (FMLA) imposes complex requirements on granting employee leaves of absence. The requirements expose covered employers to potential liability for technical violations, even if their employees take leaves provided by the statute.
A recent decision by the U.S. District Court demonstrates risks that the FMLA requirements present. In Koji Uema v. Nippon Express Hawaii, Inc., Uema asked Nippon for a leave of absence. The first physician's certificate that Uema faxed the company said he had chronic hepatitis and could not work for three weeks.
