AN APPELLATE COURT in New Jersey has rejected a chemical industry challenge to the state's natural resource damage (NRD) claim program. That program enables the New Jersey Department of Environmental Protection (DEP; Trenton) to make companies pay for damage to, or lost use of, natural resources to fully complete their site cleanup obligations under the state's brownfields redevelopment program.
The decision has positioned industry and environmental groups for a public relations battle if industry presses for a legislative change to the cleanup program, say environmental groups.
