Jul. 28--In an unusual preemptive legal strike, Harvard University has been sued by an Internet education startup over the rights to its own name.
notHarvard.com, which packages online classes with products that might appeal to students, yesterday filed a lawsuit against the university in US District Court in Austin, Texas. The Texas company, which has no ties to Harvard, wants a judge to declare that its moniker does not infringe on the institution's trademark.
Beyond the strategy of notHarvard.com taking the offensive, the case is striking because it reflects the importance of brand names and commercial interests in distance learning, a growing field ...
