The trial court, and the majority here, analyze Ralph Seeley's claim under the privileges and immunities clause of Article 1 of the Washington Constitution as well as the equal protection clause of the 14th Amendment to the United States Constitution. I prefer the due process clause of the 14th Amendment, as argued by amicus American Civil Liberties Union of Washington Foundation because the problem is how the government treats Mr. Seeley, not that Ralph Seeley is treated differently from others.
