In the report, the WTO panel argues that the US authorities failed to properly establish that higher imports rather than any other factors caused serious injury to the US industry; the "causality test" as applied according to US legislation was wholly insufficient to show adequate evidence of a causal link. Moreover, the panel concluded that the exclusion from the scope of the quota of imports from Canada in the context of the North American Free Trade Agreement (NAFTA) was not justified since such imports had in fact been considered in the analysis which led to the measures.
