CASE FACTS: Joseph Curtin was insured by a health plan provided by Community Health Plan (CHP). He was diagnosed with prostate cancer by a CHP physician. He was examined by a surgeon at Albany hospital who, after reviewing numerous other treatment options, including seed implantation with the patient, recommended a radical prostatectomy. The patient decided to undergo the prostatectomy and began treatments in August of 1996 in anticipation of a November 1996 surgery date. A week before his surgery, the patient requested a "second opinion" by physicians in Massachusetts. The request was approved by CHP.
