he right of noncitizens to speak freely in this country has always been precarious, resting more on political tides than on notions of constitutional protection. In 1988 these tides shifted twice as Congress first gave and then took away nonnaturalized immigrants' free speech rights. But on January 26 a U.S. District Court judge in Los Angeles sought to put an end to the political swings, holding that all aliens living in the United States are constitutionally entitled to the same First Amendment rights as citizens and striking down several ideological deportation provisions of the 1952 McCarranWalter Act.
