When David Boies, the lead litigator for Vice President Al Gore, appeared before the Florida Supreme Court on Nov. 20, one of the justices asked him if the court should be concerned about the standards for judging "faulty chads." Boles said that was an issue the court should deal with and that in Florida law "the test has always been the intent of the voter." Asked if he was saying "that any mark made by the voter would be evidence of that voter's intent and should be counted as such" Boies replied, "I think so, Your Honor. ... [I]t is quite important that this court be as specific as possible in terms of the standard to be applied so that we will have uniformity."
