The United States District Court for the Northern District of Illinois has granted summary judgment in favor of Dey, LP and Dey, Inc. in a lawsuit brought by Abbott Laboratories to stop the sale of Curosurf(R), a life-saving pulmonary surfactant that is used to treat infant respiratory distress syndrome (IRDS), the leading cause of death in premature babies. Abbott markets a corresponding surfactant, Survanta(R), and was alleging patent infringement.
