WASHINGTON -- The World Trade Organization has determined that a US law prohibiting a Cuban-French joint venture from protecting the trademark rights of its premier rum in court violates international law.
On June 11, in a preliminary decision on a dispute brought to the WTO by the European Union, the trade resolution panel recommended Washington repeal a part of Section 2.11 of the 1999 omnibus appropriation bill. The US law barred Havana Club Holdings, a joint venture created by France's Pernod Ricard and a Cuban state distiller from defending the Havana Club trademark in US courts after Bacardi distributed a limited amount of rum under the Havana Club name. ...
