As the industry digests the outcome of New York Times Co. v Tasini, free-lancers in the Boston area continue to fight a year-old Boston Globe contract which specifies the retroactive conferring of digital rights to the newspaper.
The U.S. Supreme Court ruled June 25 that publishers did not have the right to distribute free-lancers' work in digital form without their written permission. The seven-two decision rejected arguments by the five defendants -- the Times Co., Newsday, Time Inc., LexisNexis and University Microfilms International -- that copyright law protected such use of free-lance material.
