Trademark Rights, False Advertising Laws Enhanced Significant changes to the United States trademark laws were recently enacted and will become effective on Nov. 16, 1989. The legislation is very favorable to trademark owners and franchisors. It is particularly significant for the foodservice industry, because of its heavy reliance on trademarks.
The most significant change will allow trademark applications to be filed before a trademark is used. Under existing law, there must be use of the trademark in interstate or foreign commerce before the trademark owner may file an application for federal registration of the mark.
