Attorney General John Ashcroft increased the allowable detainment period for aliens accused of violating U.S. law on Sept. 18, one week after the terrorist attacks. Since this could be done under administrative authority through the Immigration and Naturalization Service (INS), it was not necessary to consult Congress. The limit on such detainment without filing charges was doubled from 24 hours to 48 hours.
The order signed by INS Commissioner James W. Zigler also provides for the continued custody of individuals "in the event of emergency or other extraordinary circumstance." This allows a "reasonable" but unspecified period of additional ...
