An Ohio man who police say was drunk when he raced his golf cart down the 17th fairway at a Kenton County golf course must stand trial on a drunken-driving
charge, a judge has ruled.
Circuit Judge Steve Jaeger, overruling a decision by District Judge Ann Ruttle, said a golf cart is a motor vehicle for the purposes of the DUI laws.
''The legislature did not intend to prohibit an intoxicated person from operating a motor vehicle anywhere in this state, . . . (and then) exclude from the definition of 'motorvehicles' vehicles not being driven on a public highway,'' Jaeger wrote.
