IS EX PARTY CONTACT BETWEEN A PATIENT'S PHYSICIAN AND OPPOSING COUNSEL BARRED? That was the issue with which the Texas courts were confronted in this unusual case involving septicemia (flesh-eating bacteria). One of the key issues which arose in the case was whether or not it was appropriate for opposing counsel to contact a plaintiff-patient's treating physician. One court ruled it was.
