Eight dairy farmers cannot sue a group of cheese companies alleging they manipulated cheese prices to drive down the cost of raw milk, the Wisconsin Supreme Court ruled Tuesday.
The six justices who participated in the decision deadlocked on the case, which means the decision of the Fourth District Court of Appeals was upheld.
The appeals court ruled in June that federal case law prevents people from suing for damages over lawful rates established by a federal agency through formal rulemaking.
